On 1 July 2023, the so-called ‘sports labour reform’ (Legislative Decree No. 36/2021) came into force. According to the new rules, among other things, the statutes of amateur sports bodies must contain certain fundamental elements for the purpose of sports recognition.
The decree does not provide for a deadline by which these amendments must be adopted, but the corrective legislative scheme of the aforementioned decree provides that this can be done by 31 December 2023.
The amendment will have to be adopted by resolution of the extraordinary assembly, in compliance with the constitutive and deliberative quorums set forth in the bylaws. It should be noted that the non-conformity of the bylaws with the statutory requirements set out in the decree renders the application for registration in the National Register of Amateur Sports Activities inadmissible and, for those already registered, leads to their automatic cancellation from the same.
